Who is in Management of Trucking Regulations?

Trucking Rules and Commands are observed mainly by two organizations, one at the general level and one at the state level.

The federal-level regulation that establishes and enforces trucking rules and commands is the Federal Motor Carrier Safety Administration (FMCSA), a sub-branch of the Department of Transportation.

A list of the rule, management, and laws enacted by the FMCSA can be located in Title 49.

At the state level, companies such as the state department of transportation and the department of public safety.

Depending on the state, there may be several rules and regulations that Truck Drivers must follow.

Although there are many different rules in point, the main sections that they apply to insert:

  • Hours of Operation
  • Licensing Requirements
  • Driver Drug Testing
  • Securing Cargo
  • Special Training and Physical Requirements
  • Electronic Logging Device Rule

To which carriers do these rules and laws apply?

The Federal Motor Carrier Safety Administration’s Rules execute Commercial Motor Vehicles to keep our roads as secure as possible.

According to the Regulations: a vehicle is supposed to be a CMV if it is used as a part of a business that is included in interstate commerce and fits any of the following:

  • Weights 10,001 lbs or more
  • It is used or intended to transport 16 (not including the driver) or more travelers for consideration
  • Has a whole vehicle gross combination or weight rating of 10,001 lbs or more
  • Is transporting hazardous elements in quantity demanding placards
  • It designs or used to transport 9 or more passengers (including the driver) for compensation

If any of the initial requests to the vehicle in question, then that vehicle must follow the rules and ordinances set forth by its separate state and the FMCSA.

Licensing Requirements

Commercial Truck drivers must have a CDL (commercial driver’s license) according to part 383 of title 49. To get a government-issued CDL, special conditions must be met, including:

  • the physical condition must be excellent and able to take medical verification.
  • Keep a Regular Drivers License
  • Pass the CDL knowledge and road tests
  • Have an Approximately Clean Driving Record
  • Are at least 21 years of age

If a person can pass all of the above conditions, they will usually obtain their Commercial Drivers License.

Furthermore, if a driver wants to transport hazardous materials, they are usually required to pass additional testing before earning a valid license.

Hours of Service

The Hours of Duty commands enacted to help reduce the risk of driver exhaustion that can often lead to accidents.

Hours of Service Regulations are limitations concerning the significance of driving Commercial Truck Drivers can complete in particular time frames.

These organizations introduce the following parameters:

  • After coming on duty, drivers cannot drive exceeding their 14th hour in a row.
  • Truck Drivers are not supported to drive after 60 hours in 7 days in a line.
  • Truck drivers can run for 11 hours each day only after 10 following hours off duty if hauling property.
  • Truckers must take at least one 30-minute rest during the first eight hours of their spells.
  • If a driver runs 70 hours of driving within a week, they may only continue driving if they rest for 34 hours, right. So this test must involve at least 2 nights, which consists of the hours between 1:00 am – 5:00 am.

Electronic Logging Device Rule

The Electronic Logging Device is a unique device that became compulsory for all truck drivers to comply with the Hours of Service Regulations.

These devices attach instantly to a truck’s engine, making it easier for drivers to record their driving times accurately.

Special Training and Physical Requirements

 To manage their Commercial Drivers License, Truck Drivers must know special training and pass a physical exam every two years.

If a driver leaves to complete their progressive training or physical exam, they risk losing their commercial driver license.

Commercial Truck Driver Drug & Alcohol Testing  

The FMCSA has established more strict policies than laws that manage regular drivers when it comes to alcohol and controlled substances.

In order to comply with Truck Drivers:

  • Must not have a BAC of 2.02 or above during reporting.
  • May not bring alcohol with them during driving.
  • They may not have any drugs or alcohol in their system that may influence their driving skill.

Rules for Securing Cargo

The loading and guarding cargo rules were updated in 2004 to make cargo more protected and minimize the risks of becoming unhinged and slipping off a truck.

Involved in these regulations are more satisfying provisions for tying down freight and the use of better-securing things.

Depending on the type of load that a truck is moving, these regulations also need specific vehicle markings, including their Hazmat markings, USDOT number, and more.
